Terms of Service

These Terms of Service (“Terms”) govern your use of Hey Maëlle! (the “App”), operated by AnduStar, LLC (“Company,” “we,” “our,” or “us”). By creating an account or using the App, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Hey Maëlle!, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the App.

2. Account Registration

To use the App, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be at least 13 years of age to create an account.

3. Description of Service

Hey Maëlle! is an AI-powered recipe application that generates personalized recipes based on your ingredients, allergens, and dietary preferences. The App also provides recipe importing (from photos, documents, and text files), meal planning, grocery list generation, and an AI cooking assistant (“Chef Maëlle”).

4. Subscription Plans

The App offers a free tier and a paid “Pro” subscription:

• Free: Includes limited monthly recipe generation (8/month), ingredient scans (10/month), AI chat messages (10/month), 3 cookbook imports/month, 3 meal plans/month, and up to 10 saved recipes. Free forever with no credit card required.
• Pro: $6.99/month or $49.99/year. Includes unlimited* recipes, chat, and meal plans, recipe importing (Import a Recipe), unlimited* saved recipes, and additional features. *Subject to the Fair Use Policy in Section 5.

Subscriptions are billed through Apple App Store, Google Play Store, or Stripe (for web purchases) depending on your platform. Subscription terms, billing, and cancellation are governed by the respective platform’s policies. You may cancel your subscription at any time; access continues until the end of the current billing period.

Auto-Renewal: All subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period. You will be charged through your Apple ID, Google account, or Stripe payment method. You can manage or cancel your subscription in your device’s subscription settings (iOS/Android) or through your account on the web.

Import Packs: Import Pack credits (25, 75, or 200 imports) are one-time consumable in-app purchases. Import Pack credits do not expire and are non-refundable. Credits are tied to your account and cannot be transferred.

Refunds: Refunds for subscriptions and import packs are processed by Apple, Google, or Stripe per their respective store or payment policies. AnduStar, LLC does not process refunds directly. If a refund is granted by Apple, Google, or Stripe for a subscription, your Pro access will be immediately revoked. If a refund is granted for an Import Pack, the corresponding credits will be deducted from your account. Repeated refund requests may result in the suspension of your ability to purchase import packs.

5. Fair Use Policy

Pro subscription features described as “Unlimited” (including recipes, chat messages, meal plans, and saved recipes) are subject to this Fair Use Policy. These features are intended for normal, personal, non-commercial use by individual users.

To maintain service quality and availability for all users, the following generous daily limits apply to Pro subscribers:

• Recipe generation: up to 50 per day
• Chat messages: up to 200 per day
• Meal plans: up to 30 per day
• Ingredient scans: up to 30 per day
• Recipe imports: up to 10 per day

These limits reset daily and are designed to be well beyond what any individual would need for personal cooking. They exist solely to prevent automated abuse and protect the service for legitimate users.

We reserve the right to suspend or limit access to accounts that engage in automated, scripted, or otherwise abusive usage patterns that degrade service quality for other users. If you believe your legitimate use has been restricted in error, please contact us at heymaelle.app@gmail.com.

6. AI-Generated Content Disclaimer

IMPORTANT: All recipes, nutritional information, and cooking guidance generated by Chef Maëlle are created by artificial intelligence and are provided as suggestions only. They do not constitute medical, nutritional, or dietary advice.

• AI-generated recipes may contain errors, inaccuracies, or inappropriate ingredient combinations.
• Nutritional information is estimated and may not be accurate.
• Cooking times and temperatures are guidelines and may vary based on your equipment and conditions.

You are solely responsible for verifying the safety and suitability of any recipe before preparing or consuming it.

7. Allergen Disclaimer

IMPORTANT: While Hey Maëlle! uses AI to filter recipes based on your declared allergens, the allergen detection system is assistive technology and is not a guarantee of safety.

• AI may fail to identify all allergens, especially hidden or uncommon ones.
• Cross-contamination risks cannot be assessed by the App.
• Ingredient formulations change; what was safe before may not be safe now.

Always read ingredient labels, verify allergen information independently, and consult your healthcare provider for medical dietary advice. AnduStar, LLC is not liable for any allergic reactions, illness, or injury resulting from the use of recipes or information provided by the App.

8. User-Generated Content

You may share recipes and reviews with the community. By sharing content publicly, you grant AnduStar, LLC a non-exclusive, royalty-free, worldwide license to display that content within the App. You retain ownership of your content and may delete it at any time.

You agree not to post content that is offensive, harmful, misleading, or violates any law. We reserve the right to remove content that violates these Terms.

9. User-Submitted Content for Recipe Import

The App allows you to submit content — including photographs, PDF files, Word documents, text files, and web page URLs — for the purpose of extracting and saving recipes to your personal collection (“Recipe Import”).

Your Responsibility. By submitting content for Recipe Import, you represent and warrant that:

• You have the legal right to access and use the submitted material (e.g., you own the cookbook, have a legitimate copy, or the content is publicly accessible).
• You are importing recipes for personal, non-commercial use only — not for redistribution, republication, or resale.
• You will not use Recipe Import to systematically extract, compile, or reproduce substantial portions of any copyrighted work, website, or database.
• When importing from a URL, you will not submit links to content that is behind a paywall, requires authentication, or is otherwise restricted in a way that prohibits your access, and you will respect the terms of service, robots.txt, and other use restrictions of the linked website.

How We Process File Submissions. Submitted files (photographs, documents, and text files) are processed by our AI systems to extract recipe data and are immediately discarded after processing. We do not store, retain, or archive any submitted files. Only the extracted recipe data is saved to your account.

How We Process URL Submissions. When you submit a URL, our servers fetch the content of the web page over HTTPS, convert it to text, and pass it to our AI systems to extract recipe data. The fetched page content is processed in memory and immediately discarded after processing — we do not store, cache, or archive the source page. We save the submitted URL itself alongside the extracted recipe so that the original source is credited and you can revisit it. Fetches are rate-limited, time-limited, size-limited, and restricted to public internet hosts for security purposes.

No Ownership Claim. We do not claim ownership of recipes you import. Imported recipes are stored in your personal collection and are not shared publicly unless you choose to share them through the App’s community features. Attribution to the original source (via the saved URL, where provided) is preserved.

Copyright Compliance. If you are a rights holder and believe Recipe Import has been used to infringe your copyright, please contact us at heymaelle.app@gmail.com. We will respond promptly in accordance with applicable law.

Disclaimer. Recipes extracted via Recipe Import are processed by AI and may contain errors, omissions, or inaccuracies compared to the original source. Always verify imported recipes — especially allergen information — before cooking. See Sections 6 and 7 for additional disclaimers.

10. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Abuse, harass, or harm other users through the community features.
• Circumvent usage limits, rate limits, or security measures.
• Use automated tools or bots to access the App.
• Misrepresent allergen information in shared recipes.

11. Intellectual Property

The App, including its design, code, AI models (as integrated), branding, and content (excluding user-generated content), is the property of AnduStar, LLC and is protected by intellectual property laws. “Hey Maëlle!” and “Chef Maëlle” are trademarks of AnduStar, LLC.

12. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANDUSTAR, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL THE TOTAL LIABILITY OF ANDUSTAR, LLC EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless AnduStar, LLC, its officers, directors, members, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

15. Termination

You may delete your account at any time via Profile → Delete Account. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the App ceases immediately. Sections 6, 7, 9, 12, 13, 14, and 16 survive termination.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Washington County, Utah. You agree to submit to the personal jurisdiction of such courts.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, through in-app notification. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and AnduStar, LLC regarding your use of Hey Maëlle!.
